THE INFORMATION WE COLLECT
Blue Harbor may collect information from you at two different stages. First, we collect anonymous, aggregate information automatically from all visitors to the Site. Second, you provide us with certain personally identifiable information when you interact with Blue Harbor through the Site.
(1) Information collected automatically: We collect “Anonymous Information,” which is non-identifying or aggregate data related to your visit to the Site. If you do nothing during your visit to our Site but browse, read pages, or download information, we will gather and store certain Anonymous Information about your visit automatically, including information about your internet connection, the equipment you use to access our Site and usage details. We may from time to time retain third parties to help us collect, aggregate and analyze Anonymous Information.
IP Addresses. We may also collect your IP address, which is a unique string of numbers that is assigned to your computer by your Internet Service Provider. Web servers automatically identify your computer by its IP address. We use your IP address to help diagnose problems with our server, administer the Site, optimize the Site, avoid hacking attacks on the Site’s servers, and gather demographic information such as the region from which your connection originated.
(2) Personally Identifiable Information: Personally Identifiable Information is any information that personally identifies you, such as your name, email address or your telephone number. Sometimes this personal information is needed when you contact us. We may ask you to provide us with Personally Identifiable Information on a voluntary basis in certain areas of the Site.
Email Correspondence. Scattered throughout the Site are links or forms that can be used to contact us so you can comment, make a complaint, make suggestions and ask questions. Your email address is required on these forms so we can answer your questions, and we want your name, too, so we can provide our answer in a mannerly way. When you contact us via email or via our Site’s web forms, we may retain a copy of the correspondence.
HOW WE USE GATHERED INFORMATION
The information you share with us may be used in a few ways:
(1) Anonymous Information: Anonymous Information is used for Site administration, troubleshooting and to help improve the quality of the Site. We may share Anonymous Information without restriction, including with existing and prospective business partners and advertisers. We do not connect Anonymous Information with Personally Identifiable Information, and none of the Anonymous Information we share will contain any information that identifies you individually.
(2) Personally Identifiable Information: Personally Identifiable Information may be used to:
- administer the Site;
- communicate with you, including sending promotional emails about our services and providing you with legal notices;
- notify you about changes to our Site or any services we offer or provide though it; and
- enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
In all cases, however, we will only use your information as permitted by law. We also may disclose Personally Identifiable Information if we are required to do so by law or we believe that such action is necessary to:
- comply with the law or with legal process;
- protect and defend our rights and property;
- protect against misuse or unauthorized use of the Site; or
- protect the personal safety or property of our users or the public.
Please note that we may not provide you with notice prior to disclosure in such cases.
We do not share Personally Identifiable Information with third parties for their direct marketing purposes.
DISCLOSURE OF CUSTOMER INFORMATION THROUGH BUSINESS TRANSFERS
As we continue to develop our business, we may buy, merge or partner with other companies or businesses. In so doing, we may share your Personally Identifiable Information with a buyer or other successor if Personally Identifiable Information is among the transferred assets.
We support the right of our visitors to choose. We have created mechanisms to provide you with the following control over your information:
- Promotional communications: If you decide that you do not wish to receive special offers or promotional communications, you can contact us at email@example.com or at the address provided below, indicating that you no longer want to receive information relating to the Site.
- Tracking Technologies and Advertising: You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent.
ACCESS AND CORRECTION
You have a right to know about the personal information that we hold about you, including the right to correct, amend or delete the information that we have on file if it is incorrect. If you wish to exercise these rights, please contact us by email or postal mail at the addresses below.
The Site incorporates safeguards to protect the security, integrity, completeness, and accuracy of the Personally Identifiable Information we have collected. Security of information communicated by or to us over the Internet is of utmost concern to us; unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. Please note that your emails or other electronic correspondence with us through the Site, like most, if not all, non-encrypted Internet communications, may be accessed and viewed by other Internet users, without your knowledge and permission, while in transit to us. For that reason, to protect your privacy, please do not use email or the contact forms provided through the Site to communicate information to us that you consider confidential. While we strive to protect your personal information, we cannot ensure or warrant the security of any information you transmit to us or through the Site, and you do so at your own risk. Depending on the nature of the inquiry, your communication may be discarded or archived. If you wish, you may contact us instead via telephone at the numbers provided throughout the Site.
We may change, modify, add and/or delete all or portions of this Policy at any time, at our discretion, and modifications are effective upon being posted on the Site. If we change this Policy, we will post a link to those changes on the home page of the Site and any other places we deem appropriate so that you are aware of the changes. You are responsible for reviewing this Policy periodically to ensure that you are aware of any changes to it.
How the Tool Works. For each visit to the site, the Tool: (1) identifies the traffic source for the visit; and (2) issues a unique visitor ID number and visitor traffic number. As the user navigates the site, the Tool may track and store the pages visited and features used. The Tool also may link information provided through forms featured on the site or during phone calls with a visitor ID number. Using local storage, the Tool may also store data in the user's Internet browser or in a data repository on the user's device for purposes of associating the user with his or her user profile. The Tool operates only on our site and phone system – it does not track information regarding your use of other sites or activities on other sites.
You expressly acknowledge and agree that the information associated with your user profile may be used to understand and analyze the usage of the site, and for the purposes of marketing our products or services to you. In particular, the Tool may automatically generate and send email marketing communications to you (to the extent you have provided your email address as party of your interactions with the site and/or the company associated with the site). The content of those email marketing communications may be based on the pages that you have visited and/or the features you have used on the site. The information associated with your user profile will not be used or disclosed to third parties other than for the purpose for which it was collected, without the user's prior consent. By using this site, you consent to the collection, use and disclosure of your personal information as described herein. If you do not consent, you may opt-out of the use of the Tool (as set out below).
Blocking and/or Disabling the Tool. The Tool gathers information about the user's computer hardware and software configurations to identify the user each visit and associate the user with their existing user profile. Unlike a "cookie", and except for local storage discussed below, the system does not store a file on the user's computer; therefore, the user information gathered is not deleted when the user clears their cache and/or deletes their cookies. Opt-Out. The Tool's opt-out functionality is cookie based, so for it to work for you, your browser must allow third party cookies. If you change computers, browsers or delete this cookie, we will no longer know you have opted out, so you will need to opt-out again. To opt out, Click Here.
You may also opt-out of receiving email marketing communications generated by the Tool by sending a request to firstname.lastname@example.org, or by clicking the unsubscribe link on any such email marketing communication you receive.
Do Not Track Signals. IF YOU DO NOT WANT THE TOOL TO GATHER INFORMATION ABOUT YOUR USER PROFILE AND SITE VISIT, NOW AND FOR FUTURE BROWSING SESSIONS. REFRAIN FROM USING THE SITE. WE DO NOT CURRENTLY RESPOND TO DO NOT TRACK (DNT) SIGNALS.
As noted above, the Tool may also collect and store information (including personal information) locally on your device using mechanisms such as browser web storage and application data caches. Browser web storage enables websites to store data in a browser on a device. When used in "local storage" mode, it enables data to be stored across sessions. Similarly, an application data cache is a data repository on a device. You may stop local storage from being used by modifying your Internet browser settings, but stopping local storage may result in the site having impaired or limited functionality. Furthermore, disabling local storage will not block the Tool from operating; rather, it will only prevent the Tool from collecting and storing information locally on your device. Further, you should refer to the help provided by your Internet browser for the most up-to-date and accurate instructions on disabling local storage.
Accessing, Correcting, and Updating Your Personal Information. We keep information associated with your user profile for as long as we think is necessary or advisable, and we reserve the right to retain it to the full extent permitted by law. If required by law, a governmental order, or similar legal process, we will disclose your information.
Children. This site is not directed at children under age 16, and are prohibited from using this site. We do not knowingly collect personal information from children under age 16, and if we learn that the Tool has collected information of a child under age 16, we will delete the information.
European Union Privacy. If the processing of your information in connection with Tool is subject to the General Data Protection Regulation 2016/679 ("GDPR"), we have additional obligations and you have additional rights under the GDPR. These rights and obligations are as follows: We will process your personal information using the Tool in order to support our provision of services in connection with your use of the site. The lawful bases for processing your personal information may include:
When you have given consent;
When processing is necessary for the performance of a contract to which you are a party or in order to take steps at your request prior to entering into a contract;
When processing is necessary to protect Adpearance's or our legitimate interests or that of a third party, except where such interests are overridden by your interests or fundamental rights;
Processing is necessary for compliance with a legal obligation to which we or Adpearance are subject; and
Processing is necessary to protect the vital interests of the data subject or of another natural person.
You have many rights with respect to our processing of your personal information. Depending upon the lawful basis of processing, you may have the right to withdraw consent or object to our processing your personal information.
You have the right to be informed about your personal information and how it is being processed, to access, correct and erase personal information, to restrict further processing, to obtain and reuse your data for your own purposes across different services and to object to processing. You also have the right to lodge a complaint with the relevant EU supervisory authority.
If we transfer your personal information to a recipient in a country outside the European Economic Area, we will do so in compliance with applicable laws with respect to such transfer.
Applicable Law. The Tool is operated and controlled from offices in the United States. If you access the site from locations outside the United States, you do so at your own risk and are responsible for compliance with applicable local laws. Your access to the site constitutes your agreement to our storage of your personal information within the United States.
